These provisions formed the basis of the strategy of the world community in the field of education in the second half of the 20th century, and they did not lose their significance at the beginning of the 21st century.

2. Declaration of the Rights of the Child (1959)– is the first international document, which encourages parents, as well as voluntary organizations, local authorities and national governments, to recognize and respect children's rights through legislation and other measures. The 10 principles set out in the Declaration proclaim the rights of children to a name, citizenship, love, understanding, material security, social protection and education, the opportunity to develop physically, mentally, morally, spiritually in conditions of freedom and dignity. The Declaration pays special attention to the protection of the child. It states that the child must receive timely assistance and be protected from all forms of neglect, cruelty and exploitation. The Declaration for the first time formulated the principles on which state policy to ensure the rights of the child should be based. The Declaration contained humanistic principles and was the basis for another the most important document– Convention on the Rights of the Child.

3. Convention on the Rights of the Child (1989) became a significant event in the field of children's rights. This legal document, consisting of 54 articles. The UN Convention on the Rights of the Child is not only a high-level document of international law, but also a document of great psychological and pedagogical significance. When developing the “Convention”, issues were resolved that are common and significant for all children from 0 to 18 years old; there is no nationality or racial priority in it - they are the same.

For the first time, the child is considered not only as an object requiring special protection, but also as a subject of law who is granted the full range of human rights. The Convention recognizes that every child, regardless of race, colour, sex, language, religion, political or other opinion, national, ethnic or social origin, legal right on: education; development; protection; active participation in the life of society.

The Convention links the rights of the child with the rights and responsibilities of parents and other persons responsible for the lives of children, their development and protection, and provides the right to participate in decisions affecting their present and future. The “Convention” is a synthetic document; the teacher must develop his own ways to implement this document.

The implementation of the ideas of the “Convention” is a serious, purposeful work of educational institutions to improve the quality of educational work with children.

4. Federal Law “On Basic Guarantees of the Rights of the Child in the Russian Federation.” It specifically highlights special category children in need of protection from the state. Along with disabled children, children victims of armed and interethnic conflicts, this category includes children with behavioral disorders. The law introduces the concept of “social services” for children and provides for the need to ensure their social adaptation and rehabilitation.


5. Law of the Russian Federation “On Education” (early 90s). The right of a preschool child to education is guaranteed by the state. This law is dedicated to the education of children preschool age. 6. National doctrine of education in the Russian Federation acts as a political and legal basis for legal regulation Russian system education. The doctrine for the first time set the vector of development of Russian society in the context of the development of education. The doctrine reflects the national idea that underlies the content of education and is aimed at reviving the spirituality and morality of the population, the formation of a modern scientific worldview, a culture of interethnic and interfaith relations.

In the context of modernization of education, attention is drawn to Federal Law “On approval of the Federal Target Program for the Development of Education” (for 2006-2010), Regional target program “Development of the education system of the Kostroma region in 2010-2013", order of the Ministry of Education and Science “On the Concept of modernization of Russian education for the period until 2010” and development of educational projects standards for the activities of educational institutions various types and types.

The Federal Target Program for the Development of Education for 2006 - 2010 has as its strategic goal providing conditions for meeting the needs of citizens, society and the labor market in quality education by creating new institutional regulatory mechanisms in the field of education, updating the structure and content of education, developing the fundamentality and practical orientation of educational programs, formation of a system of continuous education.

The goal of the development of education in the Kostroma region is to ensure the availability of quality education, focused on the formation of a competitive personality that meets the requirements of innovative development of the region's economy and public demands.

The development of preschool education in the Kostroma region involves:

Increasing the number of places in preschool educational institutions;

Improving the quality of preschool education;

Development of human resources potential of the preschool education system;

Ensuring conditions for the safety of children in preschool educational institutions.

The document identifies a number of unresolved problems that exist today. Thus, there remains a shortage of places in the preschool education system of the Kostroma region. In the context of the transition of preschool educational institutions to innovative educational programs and teaching technologies, there is a need for information, scientific and methodological support. Questions also remain regarding the equipment of medical offices, isolation wards, fire warning systems, and alarm systems.

Question No. 4. Regulatory documents in the activities of a teacher of a preschool educational institution: the necessary package.

Characterizing the necessary package of regulatory documents when carrying out work in a preschool educational institution, it seems possible to determine the following components: international documents, federal laws, regional legislative acts and local acts of the educational institution.

International documents are the basis for constructing guidelines and basic mechanisms of the educational process and interaction with the child. You should independently familiarize yourself with and adequately introduce participants in the educational process (including children and parents) to the Declaration of the Rights of the Child and the Convention on the Rights of the Child.

Federal laws are the normative basis for the development of program and organizational documents of the institution. All teachers of the institution should be familiar with them. This includes

The difficult situation that has developed in the modern system of preschool education in the Russian Federation is further complicated by the fact that it has not yet been developed and approved State educational standard for preschool education.

The standard must be based on a scientifically verified strategy for the modernization of preschool education, which links together its social, organizational, financial, economic, programmatic, methodological and other priorities, defining a well-thought-out program of action in the preschool education system.

Twelve years ago, in 1996, by order of the Minister of Education of the Russian Federation, “Temporary (approximate) requirements for the content and methods of education and training implemented in a preschool educational institution” were established. These requirements relate both to educational programs and pedagogical technologies, and to the nature of interaction between staff and children. As stated in the document itself, the Temporary requirements are valid until the introduction of the State educational standard for preschool education, work on which is currently underway.

1. On the one hand (as we have already noted above), the right of a preschool educational institution to choose a program is enshrined in law (as we have already noted above) in the “Model Regulations on a Preschool Educational Institution” (1995). At the same time, experts in the field of preschool education warn that programs that have not passed the appropriate examination at the federal or city level should not be used when working with children.

2. On the other hand, a provision has been legalized according to which: “A recommendation for the use of a program (score) is not the only guarantee of receiving a high assessment of the activities of a preschool educational institution during its certification. The assessment of educational activities comprehensively takes into account not only the quality of the programs on the basis of which the preschool educational institution builds its work, but also the level of its implementation. Experience shows that a number of programs that do not have a stamp, provided they are implemented correctly, can ensure the fulfillment of the Temporary (approximate) requirements for the content and methods of education and training implemented in a preschool educational institution.” (“On the implementation of the right of preschool educational institutions to choose programs and pedagogical technologies” (letter of the Ministry of Education of Russia dated 02.06.98 No. 89/34-16.)


At the same time, the State educational standard for preschool education is under development.

On regional level teachers need to become familiar with regional legislative acts(for example, the law of the Kostroma region on guarantees of the rights of the child in the Kostroma region), orders and recommendations of regional and municipal education authorities.

At the level of an educational institution, the main document regulating the work of a teacher becomes the work program. According to the standard regulations on a preschool educational institution, it is independent in choosing a program from a set of variable programs recommended government agencies education management, making changes to them, as well as developing their own (author’s) programs in accordance with the requirements of the State educational standard.

In accordance with the official document “On software and methodological support for preschool education - in the context of development pedagogy” (Instructive and methodological letter of the Ministry of Education of Russia dated March 24, 1995, No. 42/19-15, signed by the Deputy Minister of Education of the Russian Federation), the stamp “Recommended” The following programs were received by the Ministry of Education of the Russian Federation:

In order to protect the child from incompetent pedagogical influence in the conditions of variability in education, the Ministry of Education of Russia in 1995 prepared a methodological letter “Recommendations for the examination of educational programs for preschool educational institutions of the Russian Federation” (Methodological letter of the Ministry of Education of the Russian Federation dated April 24, 1995 No. 46/ 19-15), where it was stated that comprehensive and partial programs should be built on the principle of person-oriented interaction between adults and children and should ensure: protection and strengthening of the physical and mental health of children, their physical development; the emotional well-being of each child; child's intellectual development; creating conditions for the development of the child’s personality and creative abilities; introducing children to universal human values; interaction with the family to ensure the full development of the child.


Programs should be aimed at developing curiosity as the basis of cognitive activity in a preschooler; development of the child’s abilities; formation of creative imagination; development of communication.

Programs must ensure the protection and strengthening of the physical and mental health of children, their physical development; the emotional well-being of each child; intellectual development of the child; creating conditions for the development of the child’s personality and creative abilities; introducing children to universal human values; interaction with the family to ensure the full development of the child.

Programs should provide for the organization of children's life in three forms: classes as a specially organized form of education; unregulated types of activities; free time provided for a child in kindergarten during the day.

Programs should be built taking into account types of activities specific to preschool children (games, construction, visual, musical, theatrical activities, etc.);

Programs should provide for the possibility of implementing individual and differentiated approaches to working with children.

Modern programs are classified into variable and alternative; basic, federal, regional, municipal; basic and additional; approximate; complex and partial programs.

Any program is complemented by a number of local acts accepted by the institution. The main document regulating the activities of the institution , is the Charter adopted at the general meeting of the labor collective. The list of local acts includes provisions, rules, instructions, programs (development programs, educational programs), plans, staffing table, class schedule, orders and instructions of the head of the preschool educational institution, decisions of the Council of Teachers, decisions of the Council of the preschool educational institution, collective agreement, agreements on the relationship between parents (legal representatives) and the preschool educational institution. An important block of local documents consists of instructions that ensure the health and safety of all participants in the educational process.

The main normative legal documents of the federal level: the federal law of the Russian Federation “On education in the Russian Federation from the Federal Law” and the order of the Ministry of Education and Science of Russia from “On approval of the federal state educational standard of preschool education” - have made significant adjustments to the preschool education system and require changes, as in normative legal framework DO, and in the activities of teaching staff. A teacher’s knowledge of regulatory documents is the key to his legal literacy, increasing professional competence, allowing the educational process to be carried out with preschool children in accordance with current legislation. The object of my work is the regulatory framework of the preschool education system. The subject is regulatory documents and acts regulating the introduction and implementation of the Federal State Educational Standard for Preschool Education and the federal state educational standard for preschool education. Goal: Systematization and generalization of the content of regulatory documents regulating the introduction and implementation of the Federal State Educational Standard for Preschool Education and the federal state educational standard for preschool education. To achieve the goal, I set the following tasks: 1. To study and characterize regulatory documents and legislative acts of the preschool education system. 2. Preschool education is financed by analogy with school education - by local governments of municipal districts and city districts and by state authorities of the constituent entities of the Russian Federation. The educational program of preschool education is implemented in a preschool educational organization.

8 According to Art. 12 clause 6 educational programs of preschool education are developed and approved by the organization carrying out educational activities in accordance with the federal state educational standard of preschool education and taking into account the corresponding exemplary educational programs of preschool education. In Art. 11 clause 2 states that federal state educational standards, with the exception of the federal state educational standard of preschool education, educational standards are the basis for an objective assessment of compliance with the established requirements of educational activities and training of students who have mastered educational programs of the appropriate level and appropriate focus, regardless of the form of education and forms of training, i.e. mastering educational programs of preschool education is regulated by federal state educational standards, but is not accompanied by intermediate certifications and final certification of students. The law prescribes in great detail how the education of children with disabilities, disabled children and children with certain health limitations should be organized. According to paragraph 2 of Art. 65 for the supervision and care of a child, the founder of an organization carrying out educational activities has the right to establish a fee charged to parents (legal representatives). A preschool educational organization is an educational organization that, as the main goal of its activities, carries out educational activities according to educational programs of preschool education, supervision and care for children. We see that the Federal Law has made many changes to the preschool system. Hence, there is a need to develop a new document regulating relations in the field of preschool education. Part 1, clause 1.7 states that the standard is the basis for: 1) development of the Program; 2) development of variable exemplary educational programs for preschool education (hereinafter referred to as exemplary programs); 3) development of standards for financial support for the implementation of the Program and standard costs for the provision of state (municipal) services in the field of preschool education;

10 4) objective assessment of the compliance of the Organization’s educational activities with the requirements of the Standard; 5) forming the content of professional education and additional professional education of teaching staff, as well as conducting their certification; 6) providing assistance to parents (legal representatives) in raising children, protecting and strengthening their physical and mental health, developing individual abilities and the necessary correction of violations of their development. The standard is a set of mandatory requirements for preschool education (to the structure of the program and its volume, conditions for implementation and results of mastering the program). The requirements for the structure of the educational program of preschool education indicate: - The program is developed and approved by the Organization independently in accordance with this Standard and taking into account Sample programs(Part 2, clause 2.5). - The content of the program should cover the following educational areas- social and communicative development, cognitive development, speech development, artistic and aesthetic development, physical development (Part 2, Section 2.6). - The program consists of a mandatory part and a part formed by participants in educational relations (part 2, clause 2.9). - The program includes three main sections: target, content and organizational, each of which reflects the mandatory part and the part formed by the participants in educational relations (part 2, clause 2.11). - An additional section of the Program is the text of its brief presentation. A brief presentation of the Program should be aimed at parents (legal representatives) of children and available for review (Part 2, Section 2.13). Requirements for the conditions for the implementation of the Program include requirements for the psychological, pedagogical, personnel, material, technical and financial conditions for the implementation of the Program, as well as for the developing subject-spatial environment (part 3.1). The Standard's requirements for the results of mastering the Program are presented in the form of targets for preschool education, which represent social-normative age characteristics of the child's possible achievements at the stage of completing the level of preschool education (Part 4

Targets are not subject to direct assessment, including in the form of pedagogical diagnostics (monitoring), and are not the basis for their formal comparison with the real achievements of children. They are not the basis for an objective assessment of compliance with the established requirements of educational activities and training of children. Mastering the Program is not accompanied by intermediate certifications and final certification of students (Part 4, Section 4.3).
