Important! Russia has adopted a law on new benefits for children under three years of age. The new norms increase the limit that allows you to receive benefits for the first and second child, and extend the period of payment itself from 1.5 to 3 years. But many confused the two projects and decided that in 2019 it was the “offensive” child benefits that were increased.

What child benefits were increased in 2019

The adopted law on the payment of benefits for children under three years of age changes the rules by which monthly benefits are paid for the first and second child (Federal Law dated August 2, 2019 No. 305-FZ). Russia has adopted a law on child benefits up to 3 years of age, but not the one that was widely circulated on the Internet. We are talking about benefits for the first and second child born after January 1, 2018 (Federal Law No. 418-FZ dated December 28, 2017).

Some media outlets wrote that the State Duma adopted in final reading a bill to increase child care benefits up to 3 years of age. But this is not entirely true.

Currently, the benefit approved by Vladimir Putin is received by every family in which the average per capita income does not exceed one and a half times the subsistence level of the working-age population in the corresponding constituent entity of the Russian Federation for the second quarter of the year preceding the application.

The benefit for the birth of the first child is paid by social security, and for the second child - by the pension fund. Benefits for the first and second child in 2019 are paid until the child reaches 1.5 years of age. According to the law, they decided to increase this age to 3, hence the confusion.

Currently, the amount of the benefit is the subsistence minimum for children, which is accepted in the corresponding region of the Russian Federation. Accordingly, indexation takes place annually - the minimum increases and with the new minimum the amount of benefits increases.

Why Russia adopted a law on new benefits for children under three years of age in 2019

Vladimir Putin, in his address to the Federal Assembly, proposed paying monthly child benefits to families whose income is below two subsistence levels. The President indicated that the birth of children should not mean a sharp drop in the level of well-being for families.

In addition, during a direct line on June 20, 2019, Putin promised that starting from 2020, more families would receive benefits.

Therefore, legislators had to agree. Deputies also supported amendments introducing payments for such families from 1.5 to 3 years for first and second children in the amount of the subsistence minimum established in a particular subject of Russia. In 2019, on July 24, the State Duma adopted in final reading a bill to increase benefits for 1 and 2 children. And the President signed the long-awaited law (Federal Law dated August 2, 2019 No. 305-FZ).

How and to whom will the new benefit be paid?

Who is entitled to receive benefits? On monthly allowance in connection with the birth of their first and second children, they are Russian citizens permanently residing in the Russian Federation.

The first child benefit will be paid to the woman who gave birth or adopted her first child. If a woman is dead or deprived parental rights, the child’s father will be able to receive benefits.

The allowance for the second child will be received by a citizen who has a certificate for maternity capital (Federal Law of December 29, 2006 No. 256-FZ).

Under what conditions will benefits be paid? To receive benefits, parents will need to bring proof of income. The benefit is due to citizens if the amount average per capita income family does not exceed twice the subsistence level of the working-age population established in the subject Russian Federation for the second quarter of the previous year.

Where and how often should you apply for a new benefit in 2019-2020

How often should you apply for benefits? To receive benefits, you will need to confirm your income annually. Let me explain.

When you apply for benefits and confirm your income, social security officials assign you a monthly benefit for the period until the child turns one year old. Next, you must submit a new application and confirm your income if you want to receive benefits until your child reaches two years of age. After this, you apply for the documents for the third time. And if everything is in order, then you receive benefits until the child turns three years old.

Previously, you received benefits first until the child was one year old, then until the child was one and a half years old.

On June 20, on a direct line, Vladimir Putin spoke about the changes that will affect accountants. And officials promised other innovations. One of the scandalous changes was the promise to increase compensation for children aged one and a half to three years.

How much will the new benefit be paid in 2020?

The procedure for calculating the benefit amount has not changed since 2020. The benefit will increase annually. The amount of the monthly benefit is still equal to the subsistence minimum for children established in the constituent entity of the Russian Federation for the 2nd quarter of the previous year (clause 2 of article 4 of the Federal Law of October 24, 1997 No. 134-FZ). For example, in Moscow the cost of living for children for the second quarter of 2018 was set at 14,329 rubles, in the Moscow region - 12,057 rubles. The regional authorities will set the cost of living for the second quarter of 2019 later, most likely in September 2019.

For example, in many regions additional maternity capital has been introduced for the second or third child. Monthly benefits for children in the regions, as a rule, depend on the income level of the parents.

Child benefits are indexed on a regular basis to reduce the impact of inflation on young parents. On January 1, 2019, a new benefit was introduced for the first and second child (the so-called presidential benefit). Since February, payments in a fixed amount have been increased. Please note that the Duma is considering a law according to which they want to raise the right to receive benefits from 1.5 subsistence minimums to 2. It will be reviewed in the summer of 2019. And if accepted, previous payments will be recalculated and additional payments will be made.

To receive benefits, the accounting department issues a special certificate to the employee. Employees receive a new allowance every month from the Social Security Service or the Pension Fund. News about child benefits: increasing payments to 3 years

The biggest news in June was the increase in the amount of child care benefits for children under 3 years of age. Unfortunately, internet headlines promised a little more than legislators intended.

What really happened? June 20, 2019 for consideration in State Duma a bill has been introduced. The law has already been adopted.

This law amends the law of May 19, 1995 No. 81-FZ “On state benefits citizens with children." Namely, to supplement the list of child benefits with another one - a monthly child care benefit using need criteria. The payment is provided for children from 1.5 to 3 years old.

Families whose average per capita income is no more than twice the subsistence level of the working-age population in their region are eligible for this payment. And the amount of the benefit itself will be equal to the child’s subsistence level in the region for the 2nd quarter of the year preceding the year the benefit was assigned. That is, to receive benefits you need to take the living wage for the 2nd quarter. See it in the table.

The amount of the benefit is the subsistence minimum per child, approximately its amount is 10,000 rubles. Each region has its own, use the table below to check your region.

Other news about child benefits from July 2019: changes in calculations and payments

From May 1, 2019, some benefits must be transferred exclusively to the MIR card. The reason for this was Decree of the Government of the Russian Federation dated April 11, 2019 No. 419 “On amendments to Decree of the Government of the Russian Federation dated December 1, 2018 No. 1466.” In particular, the document affected the following child benefits:

  • for pregnancy and childbirth;
  • for registration with medical organizations in the early stages of pregnancy;
  • at the birth of a child;
  • child care.

There is a caveat - if you are already paying child care benefits, you can continue to transfer money according to the old rules. But the last transfer to a card that does not belong to the MIR payment system can be made no later than July 1, 2020.

Another important news, which, however, does not concern everyone. Since July 2019, the list of regions participating in the Social Insurance pilot project has been expanded.

In December 2018, amendments were made to the Decree of the Government of the Russian Federation of April 21, 2011 No. 294.

The changes led to the fact that for the period from July 1, 2019 to December 31, 2020, the Trans-Baikal Territory, Arkhangelsk, Voronezh, Ivanovo, Murmansk, Penza, Ryazan, Sakhalin and Tula regions became new participants in the FSS project.

  • from July 1 to December 31, 2020 - the Republic of Bashkortostan, the Republic of Dagestan, Krasnoyarsk and Stavropol territories, Volgograd, Irkutsk, Leningrad, Tyumen and Yaroslavl regions.

Let us remind you that participants in the pilot project provide documents entitling them to child benefits to their territorial Social Insurance body, and the payment is made by the Social Insurance Fund itself.

It is also worth noting recent judicial practice.

For example, the resolution of the Arbitration Court of the Ural District dated 06/06/2019 in case No. A76-29523/2018 is interesting. The judge once again supported the position of Social Insurance in refusing to reimburse funds for child care benefits to a parent whose working day was reduced by only an hour. Regarding benefits unreimbursed from the Social Insurance Fund, several more recent decisions are interesting. This time the judges supported the policyholders. They considered that the refusal to reimburse benefits by Social Insurance does not change the very fact of the social orientation of such payments, which means that these amounts should not be subject to insurance premiums.

Extension of Putin payments to 3 years from 2020

On behalf of the President, significant changes were made to the law on monthly payments to families with children (the same “Putin’s” allowance). In particular, the period of receiving Putin’s benefits was extended to 3 years(previously it was paid only up to 1 year 6 months). As a result of this change, almost 70% of families where the first or second child was born will be able to take advantage of government support.

The conditions for receiving benefits from 1.5 to 3 years are the same as when receiving benefits for up to one and a half years, as they are enshrined in one law (No. 418-FZ dated December 28, 2017):

  • Payments will be received by families whose first or second child born (adopted) on January 1, 2018. Accordingly, the same families that received Putin’s for up to one and a half years will continue to receive for up to three years.
  • The parent applying for benefits must permanently reside in the Russian Federation. In addition, both he and the children must have Russian citizenship.
  • Payments for the first child are made by social protection population, and on the second - Pension fund Russia.

Let us remind you that payments for the second child are transferred from funds maternity capital. Accordingly, if the maternity capital has already been disposed of in one of the provided areas, it is impossible to receive Putin’s allowance.

The criterion of need for the appointment of Putin was increased to two subsistence minimums

Simultaneously with the decision to extend the period during which “Putin’s” benefits are paid, the conditions for their assignment were adjusted. Previously, families in which one family member had less than one and a half subsistence level could receive government support. Now the need criterion has been increased to 2 PM, that is, the circle of recipients of such support will expand.

Important: the calculation takes into account the PM value for the working population established in a specific constituent entity of the Russian Federation for the second quarter of the year preceding the year the benefit was assigned.

Average per capita income is calculated according to the following scheme:

  1. All family income for the past 12 calendar months before the date of payment is summed up. The calculation takes into account income without deduction of taxes, that is, “dirty”.
  2. The resulting amount is divided over 12 months and then divided by the number of family members. The family includes parents, adoptive parents, guardians, spouses of parents, and minor children. Grandfathers, grandmothers, uncles, aunts and other relatives are not taken into account, even if they live together.

The resulting amount is the average per capita income. If this value is less than 2 subsistence minimum wages for the working-age population, the family has the right to Putin’s payments.

Cancellation of payments in the amount of 50 rubles for children from 1.5 to 3 years old

On July 23, 2019, a draft Presidential Decree was published on the portal of regulatory legal acts, which proposes to abolish compensation payments equal to 50 rubles. They were paid in accordance with Decree of President B. Yeltsin No. 1110 of May 30, 1994 to mothers caring for a child under 3 years of age. Their employer paid them, that is, they relied only for working citizens who are on maternity leave.

The draft Decree states that compensation is 50 rubles canceled from January 1, 2020 However, for citizens who received the right to payment as of December 31, 2019, funds will be paid throughout deadline- that is, until the child’s third birthday.

Allowance for the third and subsequent children under 3 years of age

Most Russian regions have already installed monthly payments, fourth child and so on. They began to be paid in 2013 in order to implement Presidential Decree No. 606 of 05/07/2012. The amount of such benefits is established by the constituent entities of the Russian Federation and is most often equal to the child subsistence level in the region of the Russian Federation. It is paid until the child reaches 3 years of age.

The main condition for assigning such support is family need. Most often, families in which the income for each family member is less than the subsistence level are considered needy. In addition, in the draft Presidential Decree published on July 23, 2019 (it was already mentioned earlier), subjects of the Russian Federation were recommended to change the conditions for assigning such a monthly allowance for the third and subsequent children. And if the region has not yet provided for it, it will be done in 2020.

  1. Establish a monthly allowance for the third and subsequent children from January 1, 2020 and pay it until they reach 3 years of age.
  2. Payments are made in the amount of the regional children's subsistence minimum.
  3. Assign them to families in which the income for each family member is less than 2 subsistence minimum wages for those of working age, determined for the 2nd quarter of the previous year (by analogy with Putin’s benefits for the first and second child).

For this purpose, a bill has been prepared to increase the criterion of families' need - from 1.5 to 2 minimum subsistence levels per person. In 2020, a new benefit for a child under 3 years of age will be paid if the average per capita family income does not exceed two subsistence minimums for the working-age population in a constituent entity of the Russian Federation for the 2nd quarter of 2019. The right to receive benefits arises if the child is already 1.5 years old on January 1, 2020. You can receive such benefits monthly until the child reaches the age of 3 years.

Childcare benefits for children under 3 years of age in 2019 at the expense of the employer

The amount of the benefit for children from 1.5 to 3 years old is still 50 rubles per month based on Section 2 of the Procedure, which was approved by Decree of the Government of the Russian Federation dated November 3, 1994 No. 1206. In some regions, the authorities themselves allocate part of the funds from the budget to increase this payments. The amounts are not as large as they could be. 50 rubles can only be received for full months of parental leave. The procedure for determining compensation for an incomplete month is now as follows:

50 rub. : total number of calendar days in the month x number of days in the month of parental leave

Let’s say an employee is on maternity leave for up to 3 years, but returns to work on May 14. For May, an allowance of 21 rubles is provided. (50 rubles: 31 days x 13 days). The amount of compensation increases by regional coefficient, if the employee works in the Far North region. Benefits are paid as follows:

  • for the first month - on the nearest salary payment day after the payment is assigned;
  • for the rest - on the first of the dates on which the organization pays salaries.

To apply for benefits, you must submit an application for parental leave for up to 3 years and accrual of benefits. In addition to the mother, the father, adoptive parent (guardian), grandmother, grandfather, or other relative who has officially taken parental leave has the right to submit such an application.

The application must be submitted within 6 months from the moment the child turns 1.5 years old. Compensation will be awarded within 10 days from the date of filing the application. The state tries to support the rights and well-being of children. Of course, such support is often not enough. Nevertheless, today our country provides several types of child benefits from the federal and regional budgets. As a rule, the amount of benefits is reviewed at the beginning of the year. It is necessary to understand how things are going with payments in favor of children in 2019, as well as what changes will occur with benefits for disabled children.

Changes in the calculation of child benefits from July 2019

Child benefits are generally understood as any monetary accruals related to children. The list of such payments is established at the legislative level and is given in Federal Law No. 81-FZ dated May 19, 1995.

Child benefits are divided into two groups:

  • payments that the accounting department of the employing organization determines independently by calculation;
  • monetary accruals, the amount of which is established by law.

The first group includes:

  • maternity benefits;
  • child care allowance up to 1.5 years old.

The second group includes:

  • lump sum benefit for the birth of a child;
  • one-time benefit for women registered with medical institution in the early stages of pregnancy;
  • maximum monthly allowance for caring for a second and subsequent child up to 1.5 years old.

Child benefits have not changed since July of this year. Major changes in this regard took place at the beginning of the year.

However, from July, the allowance for caring for a disabled child and people with disabilities from childhood of group I will increase. Thus, payments will increase from 5.5 thousand to 10 thousand rubles.

However, it is worth keeping in mind that such benefits can be received by those parents (or other relatives) who are able to work, but chose child care over work.

On the one hand, one can be happy about the increase in benefits for caring for a disabled child, but still these funds are not enough for a comfortable life. Parents cannot take care of their children and still work officially; they have to make a choice. And this decision is sometimes not easy.

What has changed in the calculation of child benefits since the beginning of 2019

From January 1, 2019, the minimum wage increased to 11 thousand 280 rubles. In this regard, payments in favor of children were recalculated (the amount of accruals directly depends on the minimum wage approved at the federal level). The procedure for the annual increase in payments is established in clause 1 of Art. 1 Federal Law dated December 19, 2016 No. 444-FZ.

In addition, from February 1, child benefits were indexed by a factor of 1.043 in accordance with Government Decree No. 32 dated January 24, 2019. Thus, from February 1, 2019, child benefits increased by 4.3%.

Innovations at the beginning of 2019:

  1. There is an opportunity to receive cash monthly in connection with the birth of the first child. The amount of these funds is equal to the subsistence minimum at the regional level. Payments are made at the expense of the state budget.
  2. At the birth of a second child, a similar opportunity arises, but funds are accrued from the family capital allocated by the state.

The amount of maternity capital remains the same and today amounts to just over 453 thousand rubles.

When calculating child benefits, the following should be taken into account:

  • billing period (earnings for 2017–2018 are taken and divided by 730 days);
  • maximum daily earnings;
  • average earnings.

Child benefits increase annually. 2019 was no exception. This is due to the February price indexation, as well as an increase in the minimum wage level. In addition, from July 1, there will be an increase in payments for disabled children and people with disabilities from childhood of group I. Instead of 5.5 thousand, able-bodied non-working parents of such children will be able to receive 10 thousand rubles.
