Who is Maxim Martsinkevich and why is he in prison?

Maxim Martsinkevich, nicknamed Tesak, became known as the creator of the organization “Format 18” (banned in Russia - Medialeaks note), which in 2005 united Russian skinheads, large quantities releasing videos of people of nationalities other than Russian being beaten, and which became a fundamental image for the emergence of documentary film"Russia 88".

Martsinkevich is now serving his fourth sentence. judicial opinion. He received his first term for disrupting a debate between journalists Yulia Latynina and Maxim Kononenko organized by Alexei Navalny in the Moscow club “Bilingua” in 2007. At the debate, Tesak first suggested that those present burn all the democrats for the well-being of Russia, and then arranged a Nazi roll call with his supporters.

In 2008, he received three years for this under Article 282 (“Inciting hatred or enmity”). While serving this sentence, Tesak received another case to his heart's content. The article was the same, but the reason was new - the most famous video of the “Format 18” times, in which Martsinkevich and his friend, dressed in white Ku Klux Klan robes, staged the “execution” of a Tajik drug dealer followed by his “dismemberment.” As Maxim Martsinkevich himself later admitted, this video was staged.

After serving both terms, Tesak was released on the last day of 2010. He soon founded a new movement with nationalist ideologies called Restruct. Its most famous unit was the Occupy Pedophile project, within which Martsinkevich shot a video about the capture of pedophiles.

However, he received his third term not for this show, but for the videos “Stalingrad”, “Okolofutbol” and “Throw Out the Chock”. In the first video - a review of the film by Fyodor Bondarchuk - Martsinkevich, for example, compared the girls who are now dating visitors from the regions of the North Caucasus with women who, during the Great Patriotic War, Patriotic War there were relations with the Nazis. As a result - the same article 282. Tesak, however, hid from this trial in Cuba, from where he was successfully extradited to Russia by local authorities.

Only the last fourth term is different in terms of the reason for the accusations - Tesak received it not only for inciting hatred, but also for hooliganism, robbery and deliberate destruction of other people's property. As part of the Occupy-Narcophilia project, Tesak and his comrades attacked spice sellers in Moscow using batons and stun guns, and also publicly doused the victims’ property with various paints. As a result, one of the victims died.

“Lenta.ru”: How, in your opinion, will the new thing end? trial? How do you feel about the fact that your prison term may be extended? Are you ready for this?

Martsinkevich: If we take it according to the law, then a new trial can only end in the dismissal of charges or acquittal. The fact is that the prosecution contains fundamental violations that cannot be corrected in court. They, in fact, consist of a trumped-up accusation, an incompetent investigation, a prosecutor suffering from Alzheimer’s, and a very strong, politically motivated desire to close me and the entire “Restruct” movement.

For the first time, Judge Glukhov agreed that the state interest is above the law, and convicted me and the guys. Well, he covered up the flaws in the investigation by falsifying the protocol court hearings, testimonies of victims, witnesses and accused. But in Mosgor, by a miracle, which I attribute to my lawyer Krasnov, the verdict on mine and two other episodes was overturned.

This time? According to the law - justification. Logically, the new judge should not deliberately violate the law where the higher authority directly said: no violations should be allowed.

But in fact, what will happen? Russia too. Well, they will give me 10 years again. Can they come to an agreement so that the verdict stands? They can.

The Moscow City Court canceled court verdict Maxim Martsinkevich, known by his nickname "Tesak". Last year, the Babushkinsky Court in Moscow sentenced the public figure to ten years in prison. A member of the organization Restrukt, banned in the Russian Federation, was accused of extremism and inciting ethnic hatred. Maxim Martsinkevich was sentenced three times to punishment under Art. 282 of the Criminal Code of the Russian Federation. "Tesak" promoted National Socialist ideology, for which he was put in court several times.

The reason for the latest arrest was the inappropriate videos that Martsinkevich filmed for his Youtube channel. The convict was supposed to be released in 2016, but he was charged with new charges.

On July 27, 2017, the Babushkinsky Court of the capital sentenced Maxim Martsinkevich to 10 years in prison. Tesak's accomplices received a slightly shorter sentence - from 3 to 10 years in prison.

The basis for extending the sentence of former Occupy-Narcophilia participants was the fact that they attacked other people. In particular, on persons of Caucasian nationality. Among the victims were sellers of smoking mixtures.

In total, ten members of the prohibited movement appeared in court, including Tesak. As law enforcement agencies found out, between 2013 and 2014, Occupy Necrophilia carried out about 9 attacks on sellers of prohibited smoking mixtures.

One of the spice traders from Azerbaijan was killed during an attack by extremists. The rest were injured during beatings using third-party special means.

"Occupy-necrophilia" was taken away from drug dealers mobile phones and money. Based on this, the court decided to punish Maxim Martsinkevich and the rest of the organization’s members not only for extremism, but also for hooliganism, robbery and deliberate destruction of other people’s property.

Previously, Martsinkevich was sentenced to four years in prison for a video in which he staged the execution of a Tajik drug dealer. While free, the convict published the book “Restrukt”, in which he described the details of the hunt for him by law enforcement agencies for three and a half years.

Where is Tesak now?

Today, Maxim Martsinkevich, nicknamed “Tesak,” is in prison. A criminal case was opened against the public figure, so after the verdict he was sent to a maximum security colony. On May 21, 2018, it became known that the Moscow City Court decided to review Martsinkevich’s sentence, which was handed down in 2017.

The convicted person retained the right to appeal the court verdict. Tesak's lawyers helped him get his sentence overturned. The sentences for Maxim Martsinkevich’s accomplices were also commuted: Dmitry Shildyashov received up to 5 years and 10 months in a maximum security colony, Roman Maksimov - up to 4 years and 10 months general regime, Alexander Shankin - up to 5 years and 10 months of general regime.

"Tesak" considers himself innocent. According to a member of an ultra-radical organization, the government is pursuing a dual policy and, instead of drug traffickers, punishes those who fight them.
